By accessing or using Notalog ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
Notalog is a digital notary journal application that allows notaries public to:
- Create and manage digital journal entries for notarial acts
- Capture digital signatures from signers
- Lock entries with tamper-evident cryptographic hashes
- Export records as PDF or CSV files
- Track fees and generate income reports
- Validate entries against state-specific requirements
3. Eligibility
To use Notalog, you must:
- Be at least 18 years of age
- Be a commissioned notary public or applying to become one
- Have the legal authority to enter into these Terms
- Provide accurate and complete registration information
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring the accuracy of your notary profile information
- Notifying us immediately of any unauthorized access
- Keeping your commission information up to date
5. Subscription and Payment
5.1 Free Trial
New users receive a 7-day free trial with full access to all features. No credit card is required to start the trial.
5.2 Subscription Plans
After the trial, you may subscribe to a paid plan:
- Monthly Plan: $13.99 per month, billed monthly
- Annual Plan: $131.88 per year ($10.99/month equivalent), billed annually
5.3 Billing
Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period.
5.4 Refunds
We offer a 30-day money-back guarantee for first-time subscribers. Contact support within 30 days of your first payment for a full refund.
6. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose
- Create false or fraudulent journal entries
- Impersonate another person or notary
- Share your account credentials with others
- Attempt to reverse engineer or hack the Service
- Use automated systems to access the Service without permission
- Interfere with the proper functioning of the Service
- Upload malicious code or content
7. Data and Content
7.1 Your Data
You retain ownership of all journal entries, signatures, and other content you create in Notalog. You grant us a limited license to store, process, and display your content solely to provide the Service.
7.2 Data Export
You may export your data at any time using the PDF and CSV export features. We recommend maintaining regular backups of your records.
7.3 Data Security
We implement industry-standard security measures but cannot guarantee absolute security. See our Privacy Policy for details on how we protect your data.
8. Disclaimer of Warranties
Important Notice:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Notalog is a record-keeping tool. We are not a law firm and do not provide legal advice. You are solely responsible for ensuring your notarial practices comply with your state's laws and regulations.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTALOG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or business opportunities
- Any damages exceeding the amount you paid us in the 12 months preceding the claim
10. Indemnification
You agree to indemnify and hold harmless Notalog from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
11. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
- Have not used the Service for an extended period
Upon termination, you may request a copy of your data within 30 days. After 30 days, we may delete your data except as required by law for notary record retention.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
